WHITE PLAINS, N.Y. — The police officer who killed a college football player during a disturbance outside a New York bar is suing a liquor store for allegedly helping the student get drunk.

A lawyer for Pleasantville Officer Aaron Hess says Danroy Henry Jr.’s Oct. 17 death would not have happened if Henry had been sober. The lawsuit filed last week says the liquor store is liable for the injuries Hess suffered when Henry’s car hit him.

An autopsy found the Easton, Mass., student’s blood-alcohol level was above the legal limit. A grand jury cleared Hess of wrongdoing.

The lawsuit says Henry, who was under the drinking age, bought liquor before going to the bar and did not drink at the bar.

Hess has acknowledged shooting Henry to stop the car.

A call to the liquor store was not answered.
